Art Commission Pricing

These are SOME samples of my CHIBI ART commissioned works

Terms of Service for Digital Art CommissionsLast Updated: Aug 25, 2024

1. IntroductionThese Terms of Service ("Terms") govern your use of AJD_X_ART’s digital art commission services ("Services"), specifically for chibi art style commissions. By commissioning artwork from AJD_X_ART ("Artist"), you ("Client") agree to be bound by these Terms.2. Services OfferedThe Artist specializes in chibi art and semi portait style commissions. Other art styles may be commissioned, but prices may vary from the existing samples. The Services include the creation of custom digital artwork based on the Client’s request and specifications.3. Commission Process3.1 Requesting a Commission
- Clients can request a commission through direct message on X or Instagram App].
- The request must include a clear description or reference images of the desired artwork.
3.2 Approval and Payment
- Upon receiving the request, the Artist will provide a quote based on the complexity and style of the artwork.
- Payment must be made in full upfront once the commission is confirmed.
3.3 Revision Policy
- The Artist will provide up to 1 revisions during the sketch phase.
- Additional revisions may incur extra fees, to be agreed upon before proceeding.
4. Pricing and Payment4.1 Pricing
- Pricing for chibi art style commissions is based on the samples provided.
- Other art styles are subject to different pricing, which will be communicated and agreed upon during the commission process.
4.2 Payment Methods
- Payments are accepted through Gcash, Maya, BDO & Paypal
- All payments must be made in Philippine Peso.
4.2 Payment Policy Reminder For International Clients
-All payments must be made directly to my PayPal account. I do not facilitate transfers to bank accounts or other payment methods outside of PayPal.
-If you're unable to make a direct PayPal payment and require additional steps or alternative methods, I kindly suggest supporting a local artist instead. This policy ensures both parties’ security and prevents any complications or fraudulent activities.
5. Copyright and Usage5.1 Artist's Rights
- The Artist retains all copyrights to the artwork, including the right to use it in portfolios, social media, or promotional materials.
5.2 Client’s Rights
- The Client receives a personal use license to display and share the commissioned artwork.
- Commercial use is prohibited except for fundraising, cupsleeve events, and freebies. For any commercial use, additional fees will apply based on tier percentages, depending on the use case.
6. Commercial Usage Fees
- The Client agrees to pay the Artist a fee based on the intended commercial use of the commissioned artwork. The fee structure is tiered according to the scale and scope of the commercial activity as follows:
-Limited Commercial Use Fee: 10%-15% of net revenue.
Scope: This fee applies to limited commercial use, which includes activities by small businesses, indie projects, and other modest-scale commercial ventures. Examples of limited commercial use include:
-Sale of products or merchandise featuring the artwork in small quantities.
-Use of the artwork in promotional materials or branding for small or local businesses.
-Digital or print media circulation with a limited audience or distribution.
-Broader Commercial Use Fee: 20%-30% of net revenue.
Scope: This fee applies to broader commercial use, which includes large-scale commercial activities. Examples of broader commercial use include:
-Mass production of products or merchandise featuring the artwork.
-Use of the artwork in large-scale marketing campaigns, advertising, or branding for regional, national, or international companies.
-Licensing the artwork for use by third parties or for widespread distribution across various media platforms.
7. Restrictions on Usage7.1 NFTs and Digital Asset Usage
- The commissioned artwork may not be used as a Non-Fungible Token (NFT) or for any other blockchain-related use without the explicit written consent of the Artist.
- Unauthorized use of the artwork as an NFT will be considered a violation of these Terms and subject to legal action.
7.2 Proper Credit and Attribution
- When sharing or posting the commissioned artwork online, the Client must provide proper credit to the Artist, including a link/tag/mention to the Artist's website or social media profile.
- The Client must not claim ownership of the artwork or imply that they created it. The Artist’s name must be clearly displayed in the description or caption of the post.
8. Refunds and Cancellations8.1 Refund Policy
- Refunds are only available if the Artist cancels the commission.
- No refunds will be issued after the artwork has been completed and delivered.
8.2 Cancellation
- If the Client cancels the commission after payment, the payment is non-refundable.
9. Delivery9.1 Delivery Timeframe
- The Artist will provide an estimated completion time upon acceptance of the commission.
- Any significant delays will be communicated to the Client.
9.2 Delivery Method
- Completed artwork will be delivered digitally via Gdrive link/Email unless otherwise agreed upon.
10. Client Obligations- The Client agrees to provide accurate information and necessary references for the commission.
- The Client must not request artwork that infringes on copyright or depicts illegal, offensive, or explicit content unless explicitly agreed upon.
11. Disclaimers- The Artist makes no guarantees regarding the delivery of the artwork if unforeseen circumstances prevent its completion.12. Changes to TermsThe Artist reserves the right to modify these Terms at any time. Clients will be notified of any changes to the Terms via Direct Message/Email.13.
